TERMS AND CONDITIONS NON-INSTALLMENT SAVINGS/NON-INSTALLMENT iB SAVINGS

  1. Definitions
    1. Bank is PT Bank CIMB Niaga, Tbk.
    2. Debit Card is a payment instrument using a card that can be used for  financial and/or non-financial transactions in the Automated Teller Machine  ("ATM"), goods and/ or services purchasing payment transactions in  merchants using the EDC (Electronic Data Capture) by debiting the  Customer's account as a Debit Card holder.
    3. Customer is a deposit customer in which placed their fund in the Bank in the  form of savings based on the agreement between the Bank and the related  Customer.
    4. Non-Installment Savings is a third party deposit at the Bank in which its  transactions can be made at any time through counter or other electronic  media (eg ATM, SST, Cash Deposit Machine (CDM), CIMB Clicks, OCTO  MOBILE and Phone Banking) as set forth and determined by the Bank from  time to time in accordance with the Bank's policy.
    5. Non-Installment iB Savings is a third party deposit at the Bank,  with mudharabah or wadiah contract in which its transactions can be made at  any time through counter or other electronic media (eg ATM, SST, Cash  Deposit Machine (CDM), CIMB Clicks, OCTO MOBILE and Phone Banking)  as set forth and determined by the Bank from time to time in accordance with  the Bank's policy.
  2. Unless specifically specified in the Terms and Conditions of Non-Installment  Savings/Non-Installment iB Savings, therefore each term in the General Terms  and Conditions of Account Opening or General Terms and Conditions on  Account Opening on Shari-CIMB Niaga ("KPUPR-KPUPRS") issued by the Bank  shall have with the same meaning and apply to the Terms and Conditions of Non-Installment Savings/Non-Installment iB Savings.
  3. This Terms and Conditions of Non-Installment Savings/Non-Installment iB  Savings is an integral and inseparable part of the Account Opening Application,  KPUPR-KPUPRS, as well as other provisions of the Bank including but not limited to operational procedures applicable to the Bank. Should there be any  inconsistency between the provisions, then the special provisions shall prevail.
  4. As long as not specifically stated in the the Terms and Conditions of Non Installment Savings/Non-Installment iB Savings, therefore the terms and  conditions contained in the KPUPR-KPUPRS shall prevail.
  5. The Customer may open the Non-Installment Savings/Non-Installment iB  Savings through the Bank branches throughout Indonesia, or through channels provided by the Bank including but not limited through Digital Lounge, internet  banking, telesales, Phone Banking and certain events in accordance with the  applicable provisions of the Bank.
  6. The Customer shall have the right to choose the type of products of the Non Installment Savings/Non-Installment iB Savings and obtain sufficient explanation from  the Bank regarding the benefits, criteria, risks, consequences, and costs  attached to the Non-Installment Savings/Non-Installment iB Savings products.
  7. The customer is required to make an initial deposit in the amount of the minimum  deposit set by the Bank and will be informed to the Customer when explaining  the type of Non-Installment / iB Non-Installment Savings product and the Costumer shall always  place a minimum amount of funds in the minimum settling balance determined by  the Bank. In the event that there is a change in the minimum settling balance  determined by the Bank will be notified by the Bank through the Bank's branch  office, the Bank's website, and other media deemed appropriate by the Bank.
  8. The fund savings on the Non-Installment Savings/Non-Installment iB Savings  shall be guaranteed by the Deposit Insurance Agency (LPS), as long as such  fund savings are not contrary to the requirements of guarantee of the LPS.
  9. If any transaction cannot be made through electronic banking services (such as  but not limited to the withdrawals above limit ATM or ATM is not working), the  Customer may make transactions through the Bank's branch office. In this case  the Bank will only make the transaction if the Customer meets the requirements  established by the Bank, including but not limited to showing the Debit Card/proof  of identity card/passbook and/or other requirements established by the Bank.
  10. If the Customer wishes to make withdrawal transactions through the Bank's  branch offices while such cash withdrawals can be made through ATM, the  Customer shall be charged for the withdrawal transactions.
  11. The Customer must immediately inform the Bank in case of any change of  signature and/or data of the Customer which has been registered on the system of the Bank, including but not limited to changes in residential addresses or email  of the Customer. If the Customer failed and/or does not notify such changes, the  Customer shall hereby hold harmless the Bank from any claims or damages  resulting from Customer's failure to inform such changes.
  12. Upon acceptance, payment and other documents related to transactions or the  use of the Non-Installment Savings/Non-Installment iB Savings to be subject to  stamp duty or taxes in accordance with the prevailing laws and regulations in the  Republic of Indonesia shall be the responsibility of the Customer. For that, the  Bank is at any time authorized to carry out an account debiting to the Customer's account.
  13. The Bank may provide Debit Card to the Customer in accordance with provisions  set out by the Bank. The Debit Card is the property of the Bank, therefore, it must  be returned immediately after being request back by the Bank.
  14. The Terms and Conditions of the Non-Installment Savings/Non-Installment iB  Savings products that are not or have not been set out specifically shall refer to  the section of the general conditions hereof.
  15. The Bank shall have the right to:
    1. Inform the features and benefits of the other products of the Non-Installment  Savings/Non-installment iB Savings that have not been informed on the  Terms and Conditions of Non-Installment Savings/Non-installment iB  Savings; and/or
    2. Change the terms and conditions, features, benefits, and other matters  related to the Non-Installment Savings/Non-installment iB Savings provided that 30 (thirty) days before such change apply effectively, the Bank shall deliver the change  through the media of information or announcements that are commonly used  by the Bank, such as notice by announcement at the Bank offices or through  other media that is accessible by the Customer such as electronic banking  media with due regard to the prevailing laws and regulations in the Republic  of Indonesia.
  16. Having regard to the content of the Terms and Conditions of Non-Installment  Savings/Non-Installment iB Savings, the Customer shall hereby declare to be  fully responsible for any damages caused by the Customer, including but not limited to the misuse and/or abuse and/or crime  that occurs in the Non-Istallment Savings/Non-Installment iB Savings, including to any losses incurred due to any negligence and/or fault of the  Customer.
  17. The Customer declares that the Bank has provided an adequate explanation of  the product characteristics of the Non-Istallment Savings/Non-Installment iB  Savings that the Customer will take use and advantage, and the Customer has  understood and known all the benefits, consequences and risks of the Non Installment Savings/Non-Installment iB Savings products, including costs of the  Non-Installment Savings/Non-Installment iB Savings products.
  18. In order to fulfill the sharia principles, the Customer product owner of the Non Installment iB Savings hereby agrees to use the Non-Installment iB Savings and  all the facilities contained therein only for transactions in accordance with sharia  principles.
  19. These Terms and Conditions of Non-Installment Savings/Non-Installment iB  Savings have been adapted to the provisions of the laws and regulations,  including the provisions of Financial Services Authority (Otoritas Jasa Keuangan) regulations.
  1. Xtra Savings is one of the type of products of the Non-Installment Savings in Rupiah, which is  designed for individual Customers who meet the requirements set out by the  Bank, which offers the easiness and convenience in transacting supported by  unlimited access services, ease of shopping with various discounts and special  offers, as well as tiering daily interest.
  2. iB Xtra Savings is one of the type of products of the Non-Installment iB Savings in  Rupiah, which is designed for individual Customer who meet the requirements  set out by the Bank, which offers the ease and convenience of transacting  supported by unlimited access services, ease of shopping with various discounts  and special offers, as well as tiering daily profit sharing ratio.
  3. iB Xtra Savings uses 2 (two) types of contract that can be selected by the  Customer that is Mudharabah or Wad`iah.
  1. OCTO Savers Savings is one of the type of products Non-Installment Savings in Rupiah that is designed for individual Customer who meet the  requirements set out by the Bank, which the opening of the account can be  made through the Bank's branch, Digital Lounge, online or other distribution  channel, which offers the ease and convenience of daily transactions.
  2. iB OCTO Savers Savings is one of the type of products of Non-Installment iB Savings in Rupiah using Mudharabah contract that is designed for individual Ccustomer who meet the requirements set out by the Bank, which the opening of the account can be made through the Bank's branch, digital lounge, online or other distribution channel, which offers the ease and convenience of daily transactions.
  3. The Customer hereby agrees and authorizes CIMB Niaga to provide the Customer’s data which consist of name, e-mail, telephone number and/or birth date to third parties specifically in related to program, gifts provided by CIMB Niaga to the Customer.
  1. Xtra VALAS SAVING is one of the type of products of the Non-Installment Savings in foreign  currency, which is designed for individual Customer who meet the requirements set  out by the Bank, which offers the ease and convenience of transacting supported by  unlimited access services, as well as tiering daily interest.
  2. iB Xtra VALAS SAVING is one of the type of products of the Non-Installment iB Savings in  foreign currency, which is designed for individual Customer who meet the  requirements setout by the Bank, which offers the ease and convenience of  transacting supported by unlimited access services, as well as tiering daily profit  sharing ratio.
  3. IB Xtra VALAS SAVING uses 2 (two) types of contract that can be selected by the  Customer that is Mudharabah or Wad`iah.

The Supplementary Terms and Conditions for Opening an Account through OCTO  MOBILE (hereinafter referred to as the Supplementary Terms and Conditions for Opening an  Account through OCTO MOBILE and any amendments and/or revisions encompassed  therein shall be referred to as "Supplementary Terms and Conditions") constitute  additions to the OCTO MOBILE Terms and Conditions in relation to the opening of an  account through OCTO MOBILE. In this respect, the user customer (hereinafter  referred to as the "User") agrees to abide by and be bound to the following  Supplementary Terms and Conditions:

  1. Conditions and Procedures/Mechanisms for Opening an Account  through OCTO MOBILE.

    Without prejudice to the existing relevant provisions applied in the process of  opening an account via OCTO MOBILE (hereinafter referred to as "Account  Opening"), as stipulated in the OCTO MOBILE Terms and Conditions, the  following supplementary terms and conditions shall also apply to Account  Opening through OCTO MOBILE:

    1. To be able to perform the Account Opening, the User shall follow all the  necessary measures involved in the Account Opening, including but not  limited to:
      1. Prior to performing the Account Opening, the User shall:
        1. Comply with the procedures, instructions, guidelines and/or  directives established by PT Bank CIMB Niaga Tbk (hereinafter  referred to as the "Bank") from time to time as they relate to the  Account Opening
        2. Read and understand in advance, as well as agree to, these  Supplementary Terms and Conditions as stipulated in point 2.a  below.
        3. Read and understand in advance, as well as agree to, any other  terms and conditions relating to opening a specific account via  OCTO MOBILE. 
        4. Read and understand in advance all explanations of the product  features of the account to be opened by the User via OCTO  MOBILE. 
      2. A User may not cancel the Account Opening instruction once it has  been submitted to the Bank. 
      3. The Bank reserves the right to not act on an Account Opening  instruction from a User by notifying the reason thereof to the Customer  concerned, unless otherwise stipulated by the prevailing laws and  regulations, in the event that the available funds in the relevant  account are not sufficient to perform the Account Opening, if the Bank  knows or has reason to suspect that fraudulent or criminal activity has  been or will be perpetrated, or based on other considerations of the  Bank and the application of precautionary principles.
      4. The disbursement or closure of an account opened through OCTO  MOBILE shall be done through the Bank’s branch and the mechanisms  as well as the procedures for such a disbursement or closure of an  account opened through OCTO MOBILE shall follow those  mechanisms and procedures, as well as the applicable provisions, of  the Bank branch concerned.
    2. By performing an Account Opening, the User agrees to abide by and be  bound to:
      1. All of the terms and conditions stipulated by the Bank with respect to  the Account Opening, including but not limited to:
        1. The General Terms and Conditions for Opening an Account  ("KPUPR")/ The General Terms and Conditions for Opening an Sharia Account ("KPUPRS"); 
        2. The Terms and Conditions of OCTO MOBILE; 
        3. These Supplementary Terms and Conditions; 
        4. Any other terms and conditions relating to opening a specific  account via OCTO MOBILE, provided that these terms and  conditions are relevant to be applied in the Account Opening  process, as performed by the User.
      2. Any other terms and conditions of the Bank relating to the operational  procedures specified by the Bank for the Account Opening, provided  that these terms and conditions are relevant to be applied in the  Account Opening process, as performed by the User.
  2. Amendments

    The Bank may at any time amend these Supplementary Terms and Conditions.  In the event of amendments to these Supplementary Terms and Conditions, the  Bank shall give notice 30 (thirty) days prior to such amendments are put into effect by  providing information/announcements through the media routinely used by the  Bank for such purposes, such as notifications at Bank branches or through any other form of media easily accessible to the User, such as electronic  banking, with due regard to the prevailing laws and regulations.

  3. Complaints/Grievance Handling
    1. In the event of any questions and/or grievances/complaints related to the  Account Opening, the User may file a complaint either in writing to a Bank  branch and/or verbally through Phone Banking 14041 and/or by emailing  14041@cimbniaga.co.id, in compliance with the requirements and complaints  procedures stipulated by the Bank. 
    2. The Bank shall conduct an inspection/investigation into the User's complaint  in line with the applicable policies and procedures of the Bank.
  4. Miscellaneous
    1. The Bank reserves the right to impose other fees, costs and charges related  to the Account Opening, in which the provisions concerning such other fees,  costs and charges are determined in full by the Bank and informed to the  User. All fees, costs and charges, including any costs that arise in relation to  the Account Opening, shall be borne by the User, and the User agrees to pay  all costs, as determined by the Bank from time to time, for services rendered.  In the event of any changes to such fees, costs and charges, the Bank shall  notify the User thereof through notifications at Bank branches or through any  other notification media deemed appropriate by the Bank with due regard to  the prevailing laws and regulations. Unless otherwise agreed, all fees, costs  and charges shall be charged to the relevant account, without prejudice to the  right of the Bank to charge them to another of the User's accounts at the Bank. To this end, the Bank is at any time authorized by the User to debit the  Customer account in question.
    2. These Supplementary Terms and Conditions constitute an integral and  inseparable part of KPUPR / KPUPRS, OCTO MOBILE Terms and  Conditions, as well as any other terms and conditions for an account to be  opened by the User via OCTO MOBILE, and as such :
      1. Any terms used in these Supplementary Terms and Conditions, unless  explicitly declared to have a distinct definition as stated in these Supplementary Terms and Conditions, refer to the definitions used in the  OCTO MOBILE Terms and Conditions. 
      2. In the event of any discrepancies amongst the relevant provisions, the  provisions that specifically govern the matter in question shall apply.
    3.  These Supplementary Terms and Conditions have been adjusted to the  provisions of the applicable legislation, including the provisions of the  Financial Services Authority. 
    4. PT Bank CIMB Niaga Tbk is registered with and under the supervision of the  Financial Services Authority.

    In performing an Account Opening, the User hereby declares that :

    1. The personal data given by the User at the time of the Account Opening is  truthful and the Bank at any time may conduct an investigation into the veracity of  such data. 
    2. This Supplementary Terms and Conditions have provided an adequate  explanation of the characteristics of the Account Opening services or products to  be utilized by the User, to the extent that all the benefits, consequences and risks  associated with the Account Opening services or products, including the costs  inherent to these services or products, are understood and comprehended by the  User. 
    3. The User agrees to be bound to the terms and conditions of KPUPR, this Supplementary Terms and Conditions, as well as any other terms and conditions  that apply to opening a specific account via OCTO MOBILE.

The User hereby declares that they have read and agreed to this Supplementary  Terms and Conditions as well as any other terms and conditions that apply to opening a  specific account via OCTO MOBILE, and that they have read and understood the  product features of the account opened through OCTO MOBILE.
